Where the gaps usually are

Not in the policy you don’t have, but in the terms of the one you already do.

  • Cargo insurance covers the goods; CMR insurance covers the carrier’s liability. People often assume one replaces the other.
  • Theft exclusions for stops at unguarded car parks — the most common reason a claim is declined.
  • Subcontractors: is the journey still covered once the load is handed to another carrier?
  • The policy limit is lower than the value of the most expensive load.

Questions and answers

Is CMR insurance compulsory?

The CMR Convention itself does not oblige a carrier to hold insurance, but forwarders and shippers almost always require it in the contract. Without it, the carrier pays claims up to the limit out of its own pocket.

Does a CMR policy cover the full value of the goods?

No — only up to the carrier’s limit of liability (8.33 SDR/kg), unless a higher value or a special interest in delivery has been declared under art. 24 and art. 26 CMR. The gap for the cargo owner is covered by cargo insurance.

Can one policy cover the whole fleet?

Yes. A fleet policy with a single renewal date simplifies administration, and new vehicles are added by notification.
